At Core, we take your privacy seriously, and have designed our Privacy Policy (“Privacy Policy”) to help you understand how we collect, use and share your personal information and to assist you in exercising the privacy right available to you. Our Services, referred herein as “services,” have two components: We connect independent workers who are interested in jobs in the construction industry (each, a “Job”) with companies and other construction firms seeking to obtain skilled services, and we help facilitate certain task- and project-management tasks and communications between companies and other construction firms, on the one hand, and construction workers, on the other. We also provide training and other career development services. Please read the following to learn how we treat your personal information.By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information as described below.

WHAT THIS PRIVACY POLICY COVERS

This Privacy Policy covers how we treat Personal Data that we gather when you access or use our Services. “Personal Data” means information that identifies or relates to a particular individual and can – either on its own or in combination with other information – identify that individual.

Information Collected Automatically

The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, to analyze trends, learn about our user base and operate and improve our Services. Cookies are small pieces of data – usually text files – placed on your computer, tablet, phone, or similar device when you use that device to visit our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s). Our Cookies do not, by themselves, contain Personal Data and we do not combine the general information collected through Cookies with other Personal Data to tell us who you are. Performance/Analytical Cookies also help us measure the performance of our advertising campaigns in order to help us improve our campaigns and the Services’ content for those who engage with our advertising. For example, Google, Inc. (“Google”) uses cookies in connection with its Google Analytics services. Google’s ability to use and share information collected by Google Analytics about your visits to the Services is subject to the Google Analytics Terms of Use and the Google Privacy Policy. You can decide whether or not to accept Cookies through your internet browser’s settings. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, your activity over time on our Services, and your interactions with our marketing communications such as:

Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and general location information such as city, state or geographic area.
  2. Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to our Services, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access, and whether you have opened our marketing emails or clicked links within them.
  3. Precise geolocation data when you authorize your mobile device or your web browser to share your device’s location.

We may obtain information about you from other sources, including through third party services and organizations to supplement information provided by you. For example, if you access our Services through a third-party application, we may collect information about you from that third-party application that you have made public via your privacy settings. Information we collect through these services may include your name, your user identification number, your user name, location, gender, birth date, email, profile picture, and your contacts stored in that service. This supplemental information allows us to verify information that you have provided to us and to enhance our ability to provide you with information about our business, products, and Services.

Referral Information
We may offer you the opportunity to refer friends or other contacts to us and share their contact information with us. Please do not refer someone to us or share their contact information with us unless you have their permission to do so.

How We Use Your Personal Data

We process Personal Data to operate, improve, understand and personalize our Services, pursuant to our legitimate business interest. We use Personal Data for the following purposes:

  1. To meet or fulfill the reason you provided the information to us, including to match you with appropriate potential employers or to facilitate your management of tasks and projects.
  2. To communicate with you about the Services, including Service announcements, updates or offers.
  3. To provide support and assistance for the Services.
  4. To create and manage your Account or other user profiles.
  5. To personalize website content and communications based on your preferences.
  6. To respond to user inquiries and fulfill user requests.
  7. To improve and develop the Services, including testing, research, analysis and product development.
  8. To protect against or deter fraudulent, illegal or harmful actions and maintain the safety, security and integrity of our Services.
  9. To comply with our legal or contractual obligations, resolve disputes, and enforce our Terms of Use.
  10. To comply with our legal Equal Employment Opportunity Commission (EEOC) reporting obligations.
  11. To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  12. For any other business purpose stated when collecting your Personal Data or as otherwise set forth in applicable data privacy laws, such as the California Consumer Privacy Act (the “CCPA”).

We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated, or incompatible purposes without providing you notice.

As noted in the list above, we may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may send you promotional email offers or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us, which helps us improve our Services. If you have provided a cell phone number, we may send you promotional SMS/text messages.

We may use Personal Data and other data about you to create de-identified and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our Services, or other analyses we create.

Our Services may offer various tools and functionalities. For example, if you provide us with Personal Data about your friends or other contacts for the purposes of referring them to our Services, we will use such information to contact them about your referral and we will use your Personal Data to let you know if you have successfully made a referral that qualifies for a benefit.

The Services may contain links to other websites, and other websites may reference or link to our website or other Services. These other websites are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.

Our Services may include publicly accessible blogs, forums, social media pages, and private messaging features. By using such Services, you assume the risk that the Personal Data provided by you may be viewed and used by third parties for any number of purposes. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our site. Your interactions with these features apart from your visit to our site are governed by the privacy policy of the company providing it.

We may use third party APIs and software development kits (“SDKs”) as part of the functionality of our Services. APIs and SDKs may allow third parties including analytics and advertising partners to collect your Personal Data for various purposes including to provide analytics services and content that is more relevant to you. How We Share Your Personal Data

Disclosures of Personal Data for a Business Purpose

The Services are designed to help you share information with others. As a result, some of the information generated through the Services is shared publicly or with third parties. We disclose your Personal Data to service providers and other parties for the following business purposes:

  1. Auditing related to a current interaction and concurrent transactions, including, but not limited to, auditing compliance with this specification and other standards.
  2. Providing Resume Information to prospective employers at the request of users to help match candidates with potential employment opportunities.
  3. Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  4. Fighting spam/malware.
  5. Debugging to identify and repair errors that impair existing intended functionality.
  6. Short-term, transient use of Personal Data that is not used by another party to build a consumer profile or otherwise alter your consumer experience outside the current interaction.
  7. Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, providing analytic services, or providing similar services on behalf of the business or service provider.
  8. Undertaking internal research for technological development and demonstration.
  9. Undertaking activities to verify or maintain the quality or safety of a service or device that we own, manufacture, was manufactured for us, or control.

We disclose your Personal Data to the following categories of service providers and other parties:

Prospective employers where you indicate that you would like your Resume Information to be submitted for an employment opportunity posting.

  1. As stipulated above, this Privacy Policy does not apply to entities other than us, so once you disclose Personal Data to a potential employer, we do not control how that party uses and discloses your Personal Data. Individuals reading such information may use or disclose it to other individuals or entities without our control and without your knowledge, and search engines may index that information. Despite commercially reasonable efforts, we cannot guarantee the privacy of the Persona Data submitted by you. Also note that if you exchange messages with a potential employer to whom you were introduced by us, such employer may retain the message history after you terminate communications and/or close your user profile to them. We therefore urge you to think carefully about including any specific information you may deem private in information that you submit through the Services.

Service providers, including:

  1. Security and fraud prevention consultants.
  2. Hosting and other technology and communications providers.
  3. Analytics providers.
  4. Staff augmentation and contract personnel.
  5. Payment processors. We use Stripe as a services provider to process your payment for certain Services. You should reviewStripe’s privacy policy to understand how they process and retain your payment information and other Personal Data. While we may retain access to your credit card billing address, expiration date, and last four digits of the number, we do not have access to your entire credit card number.

Our Affiliates.

Parties who acquire your Personal Data through an acquisition or other change of control.

  1. Personal Data may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part).

Other parties at your direction.

  1. Other users (where you post information publicly or as otherwise necessary to effect a transaction initiated or authorized by you through the Services).
  2. Third-party business partners who you access through the Services.
  3. Other parties authorized by you.

Other Disclosures to Protect Us or Others.

  1. We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to:
    • Comply with law enforcement or national security requests and legal process, such as a court order or subpoena.
    • Protect your, our, or others’ rights, property, or safety.
    • Enforce our policies or contracts.
    • Collect amounts owed to us.
    • Assist with an investigation or prosecution of suspected or actual illegal activity.

Sales of Personal Data

In this section, we use the term ‘sell’ as it is defined in the CCPA. Over the past twelve months, we have not sold any of your Personal Data to third parties.

International Data Transfers

You agree that all information processed by us may be transferred, processed, and stored anywhere in the world, including but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We have taken appropriate safeguards to require that your Personal Data will remain protected and require our third-party service providers and partners to have appropriate safeguards as well. Data Security and Retention

We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the Internet or storing data is completely secure. We cannot guarantee the complete security of any data you share with us, and except as expressly required by law, we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content. We seek to protect your Personal Data to ensure that it is kept private; however, we cannot guarantee the security of any account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time. We otherwise store all of our information using industry-standard techniques. We do not guarantee or warrant that such techniques will prevent unauthorized access to information about you that we store, Personal Data or otherwise.

We retain Personal Data about you for as long as you have an open account with us or as otherwise necessary to provide you with our Services. In some cases we reserve the right to access, read, preserve, retain, and disclose Personal Data for longer, if doing so is necessary to (i) enforce this Privacy Policy and our Terms of Service, including investigation of potential violations hereof, (ii) comply with our legal obligations, (iii) detect, prevent, or otherwise address fraud, security or technical issues, (iv) resolve disputes or collect fees owed, (v) respond to user support requests, or (vi) protect our rights, property or safety, our users and the public. We also reserve the right to access, read, preserve, retain, and disclose Personal Data as otherwise permitted or required by applicable law, rule or regulation. We may further retain, and disclose to third parties, information in an anonymous or aggregated form where that information would not identify you personally.

PERSONAL DATA OF CHILDREN

As noted in the Terms of Use, we do not knowingly collect or solicit Personal Data from children under 18; if you are a child under 18, please do not attempt to register for or otherwise use the Services or send us any Personal Data. If we learn we have collected Personal Data from a child under 18, we will delete that information as quickly as possible. Account Deletion

Should you ever decide to delete your account, you may do so by emailingsupport@bycore.com. If you terminate your account, any association between your account and information we store will no longer be accessible through your account. Please note that we will need to verify that you have the authority to delete the account, and activity generated prior to deletion will remain stored by us and may be publicly accessible.

Mobile Location Data

You can disable our access to your device’s precise geolocation in your mobile device or web browser settings, as applicable.

You have the right to request certain information about our collection and use of your Personal Data over the past 12 months. We will provide you with the following information:

  • The categories of Personal Data that we have collected about you.
  • The categories of sources from which that Personal Data was collected.
  • The business or commercial purpose for collecting or sharing your Personal Data.
  • The categories of third parties with whom we have shared your Personal Data.
  • The specific pieces of Personal Data that we have collected about you.

If we have disclosed your Personal Data for a business purpose over the past 12 months, we will identify the categories of Personal Data shared with each category of third party recipient.

Deletion

You have the right to request that we delete the Personal Data that we have collected from you. Under the CCPA, this right is subject to certain exceptions: for example, we may need to retain your Personal Data to provide you with the Services or complete a transaction or other action you have requested. If your deletion request is subject to one of these exceptions, we may deny your deletion request.

Correction

You have the right to request corrections to your Personal Data where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information or we may refer you to the controller of your personal information who is able to make the correction.

California Resident Rights

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties’ direct marketing purposes; in order to submit such a request, please contact us at.

Nevada Resident Rights

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at support@bycore.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Data as sales are defined in Nevada Revised Statutes Chapter 603A.

Changes to this Privacy Policy

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by placing a notice on the website, by sending you an email, and/or by some other means. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
